Working with startups, small businesses, and global corporations, for over 30 years Amy Berge has provided strategic counseling and business advice on intellectual property, technology, advertising, online privacy, licensing, and related issues. As an advisor and litigator, Amy guides clients through protection of their trademark portfolios – from development and management to exploitation and enforcement and everything in-between.

Amy is practical and looks for cost-efficient solutions. Clients rely on her to manage their portfolios, handle disputes, obtain and maintain trademark and copyright registrations, resolve disputes, and negotiate agreements.

“I typically take a holistic approach to my practice, helping clients solve problems. But when it’s necessary, I will fight for my client.”

Amy has broad experience protecting her clients’ rights in the courtroom and at the negotiating table. Amy has argued lawsuits before Federal Courts and the Trademark Trial and Appeal Board. In addition, she has completed mediation training through the Kentucky Bar Association.

Her advice is informed by her time spent in-house, where twice in her career she was “on loan” to key firm clients.

Amy is committed to mentoring and promoting female attorneys and executives. She has served as Counsel for the National Association of Woman Business Owners and for Women 4 Women, a local organization committed to the needs of women and girls in the community. Currently, Amy is a Board Member and Executive Committee Member of the Jeffersontown Chamber of Commerce and the Jeffersontown Economic Development Authority.  She has also been recognized for her efforts in supporting diversity and inclusion.

Practice Area

Representative Matters

Oversees a material handling equipment manufacturer’s international trademark portfolio including enforcing the company’s single-color trademark registration (covering the color as applied to the surface of forklifts) against infringements

Involved in the management and expansion of an international portfolio of trademarks and copyright matters for an iconic U.S. – based media brand directed to the Black community

Represented a car dealership in defending a copyright infringement claim involving the dealership’s marketing software.

Managing the trademark and copyright portfolio for well-known horse racing and gaming company, including securing trademark registration for the three-dimensional configuration of a recognized architectural feature at the company’s signature racetrack.

Represented a large provider of senior living in the U.S. in an infringement action against a hotel chain seeking to introduce a new line of upper mid-scale hotels with a similar name.

Represented the exclusive U.S. distributor of a well-known brand of cigarette papers in a seven-year-long case before the Trademark Trial and Appeal Board regarding the legal use in commerce of a product extension.

Successfully represented an American manufacturer of sporting goods in obtaining an injunction against a competitor that introduced a directly competitive product in a stylized format that was confusingly similar to the trademark of our client.

Represented a U.S. tobacco processing company in a trademark action against a direct competitor in a significant and unusual case because both companies were located in the U.S. but selling a specialized product with a market limited to certain parts of Africa. The suit applied the trademark act in an extraterritorial manner – using a U.S. law to address infringement occurring only outside of the U.S.

Serves as outside non-patent IP counsel for Louisville headquartered Fortune 50 company in the health, wellness, and insurance fields.
